The usufruct is, according to article 1439 of the Portuguese Civil Code, "the right to enjoy temporarily and fully a thing or right of others, without changing its form or substance".

The usufruct can be constituted by means of contract, testament, usucapião or provision of the law. It is applicable to various situations, such as woods and cutting trees, mines, quarries, water exploitation or lace, for example.
